Précisions sur l’obligation ou non du Pass sanitaire pour le personnel de cuisine et sur le port du masque du personnel soumis au Pass sanitaire

Health Pass Published on 07/09/2021 In the Questions/Answers relating to the obligation to be vaccinated or to hold a health pass for certain professions, published on August 9, 2021 and updated on September 3, 2021, the Ministry of Labor has clarified the situation regarding the obligation or not of the Health Pass in kitchens and the possibility of removing the mask for staff subject to the Health Pass. As such, you will find below the answers to these two questions: Are kitchen staff subject to the health pass? As long as the kitchen area is not open to the public and kitchen staff never work during opening hours in areas open to the public, they are not subject to the health pass. On the other hand, as soon as these conditions are not met (open kitchen, kitchen staff serving dishes in the dining room or participating in service), kitchen staff must have a valid health pass like any restaurant employee working with the public. Is wearing a mask mandatory for employees with a pass? In accordance with the provisions of Article V of Article 47-1 of Decree No. 2021-699 of June 1, 2021, the obligation to wear a mask does not apply to persons (visitors = customers in our sector or employees) who have accessed the establishments, places, services and events covered by the pass obligation and who hold it. The wearing of a mask may however be made mandatory – including when persons hold a pass – by: • the prefect of the department when local circumstances justify it, • the operator or organizer. NB: Interactions between staff subject to the health pass and other collaborators should be avoided, particularly in changing rooms and during meals. Furthermore, given the current context, we recommend that you be vigilant if you decide to authorize the non-wearing of masks for collaborators subject to the health pass, do not hesitate to contact your occupational health service for advice.
